Notice is hereby given that the Southern Shores Planning Board will meet on December 17, 2018 at 5:30 p.m. in the Pitts Center located at 5377 N. Virginia Dare Trl. The Board will consider ZTA-18-09, a Zoning Text Amendment application submitted by the Town of Southern Shores to amend the Southern Shores Town Code by amending Section 36-132, Regulation of Structures and Uses Nonconforming. The Board will also discuss potential regulations to address large single-family dwellings. Notice is hereby given of a Special Meeting of the Southern Shores Town Council, Wednesday November 7, 2018 at 10:00 AM, Pitts Center, 5377 N. Virginia Dare Trail, Southern Shores, NC 27949.
Prior to 2015, the Southern Shores Code of Ordinances limited the number of actual bedrooms of a single-family dwelling built to seven (7) bedrooms and an occupancy of fourteen (14) persons. In 2015, the North Carolina General Assembly amended NCGS §160A-381 to prohibit municipalities from regulating, directly or indirectly, the “number and type of rooms” in a single-family dwelling. Subsequently and as an initiative to limit occupancy, the Southern Shores Town Council amended the Town Code of Ordinances to limit the size of future single-family dwellings to a maximum of 6,000 square feet of living space. Since enactment of that limitation, the Town’s Planning Department has been strictly enforcing this size limitation through its permitting authority.
Recently, some property owners have voiced alarm that an application for a permit has been submitted to the Town Planning Department proposing living space of 5,945 square feet, less than the Town’s maximum of 6,000 square feet of living space. Although the proposed living space is within the Town’s allowable maximum and the requesting party is entitled by right to receive a permit from the Planning Department if all other Town Code parameters have been met, some property owners are alarmed that the party requesting the permit has been able to design twelve (12) bedrooms within the Town’s maximum allowable 6,000 square feet of living space for a single-family dwelling.
Purpose of Special Meeting
The specific purpose of the Special Meeting is for the Town Council to (1) consider all available options, if there are any, to further limit occupancy of single-family dwellings in Southern Shores, and, (2) provide opportunity for any Council member to seek Council approval to initiate the process of adopting a specific option, if available, to further limit the occupancy of single-family dwellings, and (3) allow a period of public comment on the purpose of the special meeting, subject to the Town’s rules for public comment.
